Terms and Conditions of Use

1. Acceptance of the terms

By accessing, browsing or using the website ingar.com.uy (the “Site”), operated by INGAR Negocios Inmobiliarios (“INGAR”), you agree to be bound by these Terms and Conditions of Use. If you disagree with any of these conditions, you must stop using the Site immediately.

2. Information on the Site

INGAR publishes information about properties for sale and rent in Uruguay. The information presented (prices, floor areas, features and photographs) is provided by third parties or collected from sources considered reliable, and may contain errors or be outdated. INGAR does not guarantee the accuracy, completeness or currency of the published data, which is provided for information only and does not constitute a binding commercial offer.

3. Intellectual property

All content published on the Site—including, without limitation, text, property descriptions, photographs, images, renderings, plans, videos, logos, trademarks, graphic design, navigation structure, source code, data compilations, property databases and any other material—is the exclusive property of INGAR or its respective licensors, and is protected by the intellectual property laws of the Oriental Republic of Uruguay (in particular Law No. 9.739, as amended) and applicable international treaties.

The reproduction, distribution, public communication, transformation, modification, extraction, reuse, bulk downloading or any other form of exploitation, in whole or in part, of any content on the Site is expressly prohibited without INGAR's prior, express written authorization.

4. Prohibition of scraping, crawling and automated extraction

The use of robots, spiders, crawlers, scrapers, automated scripts, browser extensions, autonomous agents, artificial intelligence tools (including, without limitation, ChatGPT, Claude, Gemini, Perplexity, Copilot or other language models, AI agents or conversational assistants), or any other automated or bulk manual means is strictly prohibited for the following purposes:

  • Accessing, indexing, copying, downloading or extracting data from the Site, including property listings, prices, images, descriptions, contact details or any other information.
  • Reproducing, compiling or creating databases derived from the Site's content.
  • Using the Site's content to train, fine-tune, evaluate or feed any artificial intelligence model, machine learning system or derivative product without INGAR's prior, express written consent.
  • Instructing an artificial intelligence assistant to access or browse the Site, extract information or reproduce its content on the user's behalf.
  • Monitoring, replicating or duplicating any part of the Site without express authorization.
  • Overloading, interfering with or affecting the Site's infrastructure, performance or availability.
  • Circumventing, disabling or altering security measures, authentication systems, CAPTCHAs, rate limiting, robots.txt, headers X-Robots-Tag or other technical protections implemented on the Site.

Any unauthorized automated access will be considered improper access to computer systems under Law No. 18.600 on Electronic Documents and Electronic Signatures and other applicable Uruguayan legislation, and may result in civil and criminal proceedings, including claims for damages and reports to the competent authorities.

5. Prohibition of copying and unauthorized use of content

Copying, republishing, redistributing, sublicensing or making any content from the Site available to third parties, free of charge or commercially, is prohibited, including but not limited to:

  • Property listings, technical specifications or descriptions.
  • Photographs, renderings, plans, videos or multimedia material of any kind.
  • Price data, valuations, estimates or market information generated by INGAR.
  • INGAR's trademarks, logos, visual identity or graphic elements.
  • Content generated by the Site's artificial intelligence assistant.

Use of the Site's content is limited exclusively to personal, non-commercial consultation by individual users interested in INGAR's real estate services. Any other use requires INGAR's prior, express written authorization.

6. Acceptable use

The user undertakes to use the Site in good faith and solely for its intended purposes. The following are prohibited:

  • Using the Site for any unlawful, fraudulent or unauthorized purpose.
  • Attempting to access restricted areas, internal systems, third-party accounts or data not intended for the user.
  • Sending malicious content, viruses, malware or any code intended to damage or interfere with the operation of the Site.
  • Reverse-engineering, decompiling or disassembling any component of the Site.
  • Impersonating another person or entity.
  • Using the Site's artificial intelligence assistant for purposes other than property searches, or attempting to manipulate, circumvent or extract its instructions (prompt injection).

7. Privacy and personal data protection

INGAR uses responsibly the personal information entrusted to us, in compliance with Law No. 18.331 on Personal Data Protection and Habeas Data Actions of the Oriental Republic of Uruguay, its implementing Decree No. 414/009 and other applicable regulations. We take the necessary technical and organizational measures to protect data and ensure its confidentiality.

Data we collect. We collect only the data needed to provide efficient service, such as name, telephone number, email address and the inquiries or property preferences users share through the contact form, the Site's assistant, WhatsApp, telephone calls or email.

Purpose of processing. Data is used exclusively to answer inquiries, arrange viewings, send information about properties that may interest the user and improve the quality of our service. It is retained for as long as reasonably necessary to fulfill that purpose and applicable legal obligations, and is then deleted or anonymized.

Automated assistance. To provide faster, more efficient service, INGAR may use automated systems (bots, automated responders or artificial intelligence assistants) through channels such as WhatsApp, telephone or the Site's assistant. These systems process shared messages and data with the same standard of care and confidentiality as human assistance, and users may request assistance from a team member at any time.

We do not sell or transfer your data. Personal contact information (name, telephone number, email address and the content of your inquiries) is not sold, transferred or shared with third parties for commercial purposes unrelated to INGAR. It may be disclosed only to competent authorities where legally required or ordered by a court, and to service providers strictly necessary to operate the Site (hosting, messaging and analytics), who are subject to the same confidentiality duties. Browsing data collected by analytics and advertising cookies does reach Google and Meta, as explained in the following section.

Data subject rights. Every user has the right to access, rectify, update or erase their personal data, or object to its processing, at any time and free of charge, under Articles 13 to 15 of Law No. 18.331. To exercise these rights, contact contacto@ingar.com.uy.

Cookies, analytics and advertising. The Site uses three types of cookies and similar technologies:

  • Essential (first-party). These remember your cookie choice and the country from which you browse, to determine whether consent should be requested. They are not used to identify you or for advertising.
  • Analytics (Google Analytics 4). These measure which pages are visited; which properties, projects and articles are viewed; searches and filters; contacts initiated; language; device; and approximate location. They help us understand which content is useful and improve the Site. Cookies _ga and _ga_*, for up to 2 years.
  • Advertising and remarketing (Google and Meta). Through Google Signals and the Meta pixel, Google and Meta may associate this browsing activity with the accounts the user has open on their services. This allows INGAR to learn aggregate information about its audience (age ranges and interests) and show INGAR ads on Google, YouTube, Facebook and Instagram to previous visitors to the Site. Google and Meta cookies (for example _fbp, for up to 90 days).

INGAR does not send Google or Meta your name, telephone number, email address or the text of your inquiries. Google and Meta process this data as independent controllers, under their own policies, and may do so outside Uruguay (including in the United States).

When they are activated. If you browse from the European Union, the European Economic Area, the United Kingdom or Switzerland, a notice is displayed and no analytics or advertising cookies are activated (nor is the Meta pixel loaded) until you accept them. Elsewhere in the world, including Uruguay, they are activated when you enter the Site, and you can disable them at any time below. Your choice is stored in your browser.

8. Online valuation

The online valuation tool provides automated estimates based on market data. These values are indicative and do not constitute a professional appraisal. For an accurate valuation, consult our advisers.

9. Monitoring and technical measures

INGAR reserves the right to implement and maintain technical measures to protect the Site, including but not limited to rate limiting, traffic pattern analysis, bot and automated agent detection, IP blocking, device fingerprinting, verification of User-Agentheaders, use of robots.txt, headers X-Robots-Tag, meta tags noai / noimageai and any other technology needed to protect the Site and its content.

INGAR may, without prior notice, block, restrict or deny access to any user, agent or tool that violates these terms, and record evidence of such access (IP address, date and time, paths visited and HTTP headers) for possible legal action.

10. Third-party links

The Site may contain links to third-party websites. INGAR is not responsible for the content or privacy policies of those websites.

11. Limitation of liability

INGAR is not liable for direct or indirect damage arising from use of the Site or inability to access it. The artificial intelligence assistant's responses are for guidance only and do not replace professional advice from a real estate agent.

12. Indemnification

The user undertakes to indemnify and hold harmless INGAR, its directors, employees and agents against any claim, damage, loss, cost or expense (including legal fees) arising from a breach of these Terms, misuse of the Site, unauthorized automated access or infringement of intellectual property or third-party rights.

13. Jurisdiction and applicable law

These Terms are governed by the laws of the Oriental Republic of Uruguay. For any dispute arising from use of the Site, the parties submit to the jurisdiction of the competent courts of the city of Montevideo, waiving any other jurisdiction that might otherwise apply.

14. Amendments

INGAR reserves the right to amend these Terms at any time without prior notice. Amendments take effect upon publication on the Site. Continued use of the Site after any amendment constitutes acceptance of the new terms.
