Buying a lot in Maldonado: how to find out what you can build

Short answer
What you can build on a lot in Maldonado is set by the rules of the subzone where the padrón (cadastral parcel number) sits, not by the square meters in the listing. On an 800 m² solar (lot) in the Pinares subzone (3.1.5.1), for example, the ordinance allows 192 m² of footprint and 384 m² across two floors, with a 7 m height limit and no apartment blocks. Before you reserve, ask for the padrón and the cadastral certificate, have an architect confirm the rules for that padrón, and get OSE and UTE to confirm the connection.

Start with the padrón
The padrón number and the cadastral section identify the property and let you check location, area and boundaries.
- The cadastral certificate and the cadastral map are available online; the official procedure page explains how.
- In the Maldonado parcel viewer you can locate the padrón and its area before requesting anything.
- The Dirección General de Registros provides the registry information; the title review is done by your escribano (notary).
- If there are doubts about the boundaries, ask a surveyor to stake out the lot.
The Ley 18.308 on land-use planning distinguishes urban, suburban and rural land, and leaves the specific category to each department's instruments. A padrón listed as "potentially transformable" is not a building permit. The Intendencia's geographic information system is useful for a first reading of the area; the professional confirms the rules that apply to the padrón, including amendments.
The numbers: an 800 m² lot in Pinares
The Maldonado Digesto defines FOS (lot coverage) as the ratio between the covered area and the lot area, and FOT (floor area ratio) as the sum of the countable areas on all floors over that same lot area. FOS V is the share that must stay as green, unpaved ground.
In subzone 3.1.5.1 Pinares, coverage follows the general rule for zone 3.1 Barrio Jardín (art. D.211):

For 800 m², the lot sits at 60% of the range between 500 and 1,000 m²:
- FOS: 30 − (10 × 0.6) = 24% → 192 m² of footprint.
- FOT: 60 − (20 × 0.6) = 48% → 384 m² countable across floors.
- FOS V: 40 + (20 × 0.6) = 52% → 416 m² of green ground.
On top of that come the rules specific to Pinares:
- Maximum height: 7 m (ground floor and upper floor).
- Front setback: 4 m on inner streets and 10 m on the Rambla Costanera.
- Side setbacks: at least 2 m each, with an average combined total above 6 m.
- Rear setback: 3 m.
- Apartment blocks are not allowed.
- Several homes: groups of detached or semi-detached units require 600 m² per unit or per pair.
With a 400 m² lot, by contrast, the first-band values apply: 120 m² of footprint (30%) and 240 m² across floors (60%). These numbers only hold if the padrón is inside subzone 3.1.5.1: in another subzone, they change.
With that, ask an architect for a sketch of your project: house, access, parking, pool and open space. Have them put in writing what they took as given, what is confirmed and what needs an inquiry with the Intendencia (departmental government). If the lot has a steep slope, the same ordinance may require a level survey with contour lines signed by a surveyor; earthworks, retaining walls and drainage are not included in the price of the lot.
Water, sewage, power and access: one answer per provider
A power pole or a pipe on the block does not prove your padrón has a connection or what it costs. Get an answer from each provider for the padrón and the planned build:
- Water: the OSE procedure for a new service asks for the padrón and states that some connections depend on technical feasibility. For several units, check feasibility at that scale.
- Power: ask UTE for the connection cost and timeline for that padrón and the capacity you will need.
- Access: a street drawn on a plan may not be open. Visit the frontage after rain and look at ditches and runoff.
- Flooding: the Ministerio de Ambiente flood atlas includes a pilot of risk maps in Piriápolis.
If the lot is on the coast
- In the coastal protection strip, Decreto 349/005, art. 2, item 33 requires Prior Environmental Authorization for any works.
- Art. 50 of Ley 18.308 imposes a Special Plan on certain old, unconsolidated coastal subdivisions, which must set aside the first 150 m from the shoreline as open space. The professional has to say whether that case applies to the padrón.
If the lot already has a building without a permit
Departmental Decree 4118/2026 opened a scheme to regularize works built without a permit up to December 31, 2025:
- It was approved by the Junta on April 28, 2026, enacted on May 6, 2026 and published in the Diario Oficial on May 22, 2026.
- Its implementing rules (Resolución 05583/2026, art. 21) keep it in force until November 22, 2027, inclusive.
- You file with a registered professional, plans and a notarial certificate. Works that breach the rules are reviewed case by case and, where appropriate, go to the Junta Departamental.
Before you pay for what is built, order a survey of the building and ask whether it qualifies for the scheme. If the build was recent, also check its status with the BPS: what BPS construction contributions are and how to check them.
What the lot costs and what the project costs
Two current listings checked on September 26, 2026:
- 502 m² in San Carlos, USD 55,000, listed on July 6, 2026.
- 630 m² in Altos de Burnett, Pinares, USD 110,000, listed on July 28, 2026.
These are asking prices, not closing prices. Before making an offer, ask for comparables from the same micro-area and confirm which subzone each padrón falls in.
Add to the price of the lot:
- Purchase: the buyer's ITP (property transfer tax, 2% on the lower of the updated Catastro value and the price), escribano and commission. Run the numbers with the purchase cost calculator or follow the guide to purchase costs.
- Vacant lot: while you have not built, check whether the departmental tax on vacant lots applies; it is charged with the contribución inmobiliaria (property tax) depending on the zone.
- Preliminary inquiry: the preliminary building inquiry costs 10% of the building fee, credited toward the final permit.
- Permit: the building permit requires a registered professional and fees based on square meters and category. The official page does not publish a decision time: ask before you set a start date for the works.

How much can you build on an 800 m² lot in Pinares?
If the padrón is in subzone 3.1.5.1 Pinares, interpolating the Barrio Jardín rule gives a FOS of 24% (192 m² of footprint), a FOT of 48% (384 m² across floors) and a green FOS of 52%. The maximum height is 7 m, with a ground floor and an upper floor, and setbacks of 4 m at the front, 2 m at the sides and 3 m at the rear.
Can I build two houses on a lot in Pinares?
In subzone 3.1.5.1 Pinares, groups of detached or semi-detached homes require 600 m² of land per unit or per pair, and apartment blocks are not allowed. On an 800 m² lot that leaves room for one home or one semi-detached pair, always within the lot's FOS and FOT. Confirm it with an architect before making an offer.
Until when can unpermitted works be regularized in Maldonado?
Departmental Decree 4118/2026 allows regularizing works built without a permit up to December 31, 2025. Under its implementing rules, Resolución 05583/2026, the scheme runs until November 22, 2027 inclusive. You file with a registered professional, plans and a notarial certificate, and the Intendencia reviews each case that does not meet the rules.
Can you split rural land near José Ignacio or Punta del Este?
The land-use category and the planning instrument that apply to the padrón define the allowed uses. To subdivide a rural padrón, the MGAP requires a minimum of 3 hectares for each new padrón in Maldonado. If you are offered a plot "to be split off", ask for the plan and the subdivision approval before you reserve.
How much does the preliminary building inquiry cost in Maldonado?
The Intendencia charges 10% of the building fee, which is later credited as part of the payment for the final permit. The fee depends on the square meters and the category of the works. It is used to raise questions or request exceptions before filing the full project; the procedure page does not publish a response time.
