Selling a small farm or hill land in Lavalleja: how to prove its potential

Short answer
To sell a chacra (small farm) or a plot in the hills of Lavalleja, prepare the papers that prove what the listing says: padrón (cadastral parcel number) and survey plan, access, water source, permitted buildings and the land subzone or category. As a reference, Lavalleja farmland sold in 2025 for an average of USD 3,736 per hectare (DIEA, sales of 10 ha or more). If you live on the farm permanently, the IRPF (personal income tax) exemption for reinvestment may apply to the part that is your home.

First, what you are selling
"Stunning view, ideal for cabins" draws inquiries, but the deal falls through if the buyer asks about the padrón, permits or water and gets no answer. Separate two products that property portals mix together:
- A lot in Villa Serrana or Marco de los Reyes, subject to the Local Plan of Decreto 3.701/2021, with its own suburban subzones and rural areas.
- A rural farm elsewhere in Lavalleja, assessed according to its land category and the Directrices Departamentales (departmental land-use guidelines), among other rules.
The word "chacra" in the listing does not tell you which of the two you have.
A property sheet that holds up to specific questions
Basic papers
- Padrón, cadastral locality, area according to the documents, survey plan (the cadastral plan guide explains where to request it) and location of the access.
- Cadastral certificate and Lavalleja Contribución Inmobiliaria (property tax) debt.
- Title and registry status reviewed by an escribano (notary), with the Registry certificates.

Improvements, with proof
Document fences, gates, internal roads, buildings, power, water and wastewater. Tell apart "a power line runs nearby" from "the parcel has an authorized connection", and "there is a well" from "there are tests and a record of its use".

In Villa Serrana, sell the parcel and what could be built on it
In SU1 (Vilamajó) one home per plot is generally allowed. In SU2, a plot of more than 2,000 m² may allow two homes (arts. 97 and 98); one of exactly 2,000 m², one. If your parcel is in SU2 and exceeds that threshold, it is a concrete selling point.
Attach the subzone consultation and a sketch of what fits. For setbacks, water and wastewater, refer the buyer to the guide to buying land in Villa Serrana, which covers them in detail.
If your pitch is "you can build", show a technical study of that project or say it is pending. If the house is already built, have a professional compare the building with the approved plans. The Lavalleja building permit has its own requirements for Villa Serrana, including the boundary survey plan. A permit granted to another parcel proves nothing about yours.
On a rural farm, explain its real use
Farmer or country home
A farming buyer asks about soils, water, access, improvements and operating costs; the MGAP's CONEAT index is one piece of that answer. To someone looking for a country home, show where the house could go and what is known about water, power and upkeep.
If the farm is in the RP3 rural area of the Villa Serrana Local Plan, the house, complementary unit and sheds cannot exceed 250 m² in total, with a 20 m setback. If you plan to sell in plots
Confirm the plan and the procedure before you advertise them. The minimum to create each new rural parcel in Lavalleja is 5 ha, plus whatever land-use conditions apply.

Subdivisions for non-farming, residential or tourism use pay only the stamp in that procedure. The fees are adjusted every six months, do not include the surveyor, and the official page does not state a processing time.
Native woodland
If there is registered native woodland, have the registration certificate, the management plan and recent tax bills: with those the buyer can check which tax benefits apply to this parcel. What the MGAP requires and exempts is in the guide to buying farms.
Set the price against real alternatives
Compare with properties in the same land category and with similar access, distance to Minas or other towns, topography, water and infrastructure.
- DIEA 2025: in Lavalleja, 160 farmland sales averaged USD 3,736/ha, with 100 ha per deal (DIEA/MGAP). It only counts sales of 10 ha or more: it does not price a Villa Serrana lot or a small farm.
- Listings: note the asking price and the date posted, and do not present them as closed sales.
- Cadastral value: it is a tax figure. It is used for taxes and does not represent the market price.

Taxes for the land seller
Ask for a preliminary tax calculation before you set your minimum. ITP (property transfer tax), IRNR (non-resident income tax) and the worked net-with-commission example work the same as for a house and are in the guide to selling a house in Minas. What is specific to land:
Rural IRPF
- Rate: 12% of the taxable gain (DGI, rural property).
- Deemed method for purchases before July 1, 2007: 15% of the market value of the land as of July 1, 2007, plus the difference between the sale price and that value if positive. The 2007 value is obtained by deflating the price with an MEF land price index. Do not use the 1.8% of the price that applies to urban property.
If you live on the farm
The DGI exempts the sale of rural property only for the part that is a permanent home, with the same caps as in town:
- The property sold does not exceed 1,200,000 UI (unidades indexadas, an inflation-indexed unit).
- At least 50% of the proceeds goes to another permanent home.
- The new home does not exceed 1,800,000 UI.
- No more than 12 months pass between the sale and the purchase.
The exemption does not cover the productive land or an empty lot. It does not apply to a weekend farm, because that is not a permanent home. The same goes for Villa Serrana: a house where you live year-round may qualify; a vacant lot or a holiday home does not. The notary withholds the tax anyway and you then apply for a refund.

A viewing that helps close the deal
Mark the boundaries and the access and bring the property sheet. Show the spot with the best view and also where the house or the planned activity would go.
- If the road changes with the rain, say so.
- If power has to be brought in or a fence repaired, bring the quote.
- Leave the buyer a copy of the land-use consultation and the utility records so they can review them with their own professionals.
Frequently asked questions
Do I pay IRPF when I sell a farm I live on?
The part that is your permanent home may be exempt, if the property is worth up to 1,200,000 UI, you put at least 50% toward another permanent home worth up to 1,800,000 UI and you buy it within 12 months. The rest of the land pays 12% IRPF on its share of the taxable gain. A weekend farm does not qualify: it is not a permanent home. The notary withholds the tax and you then apply for a refund.
What is a hectare worth in Lavalleja when selling farmland?
The 2025 average was USD 3,736 per hectare across 160 sales of 10 ha or more, according to DIEA; the national figure was USD 4,178. It is an average for farms of about 100 ha, not the value of your parcel. To set a price you need comparables with similar soil, access, water and improvements, and you need to tell asking prices apart from closed sales.
How much does it cost to subdivide farmland in Lavalleja?
As of September 2026, the MGAP procedure fee is UYU 2,421 for up to two plots, UYU 4,851 for three to five and UYU 9,720 for more than five, plus a UYU 270 professional stamp. Add the surveyor's work on top. Each new plot must have at least 5 ha, and the official page does not state a processing time.
Can I sell a farm without having all the plans?
You can start preparing it, but the surveyor and the notary have to say what is missing and whether that blocks or delays the deed. The buyer's notary will study the titles and the survey plan before signing the deed. Sorting it out before an offer comes in avoids renegotiating the price mid-deal.
Does it help to advertise "ideal for tourism investment"?
Only if you say what is proven and what is missing. The view and visitors to the area do not prove that cabins can be built or that they will earn money; in areas such as RP3 there are floor area caps and tourism is assessed case by case. Request a land-use consultation for the parcel and, if you already rent it out, show bookings actually collected, kept separate from projections.
